La llei italiana fa una distinció important entre "obres d'art fotogràfic" i "simples fotografies" (Art. 2, § 7). Les obres d'art fotogràfic estan protegides durant 70 anys després de la mort de l'artista (Art. 32 bis), mentre que les simples fotografies estan protegides per un període de 20 anys a partir de la creació.

  • It is a cinematographic work and 50 years have passed since the date of its creation
  • It is another type of work and 50 years have passed since the death of the author (or last-surviving author)

  • It is one of "laws, decisions of courts or of administrative bodies and official translations thereof" and therefore ineligible for copyright protection.
